Chair representative Elmore, members representatives Johnson, Horne, Conrad, Langdon, Millis. The senate will be so notified. House Bill 667, the clerk will read. Representatives Hagger and Dopson. House Bill 667, A bill to be entirely enact to amend counties' remedies for facilities licence of care of mentally ill developmentally disabled substance abuse for adult care home facilities and to remove sunset pilot program to study the use of electronic supervision devices Certain facilities. General Assembly of North Carolina enacts. >> The gentleman from Wake Representative Dollar is recognized for a motion. >> I move to concur with the Senate committee substitute House Bill 667. >> Gentleman has moved that the House do concur with House Bill 667, the gentleman has the floor to debate the motion. >> Thank you Mr. Speaker, members of the house. This is actually House language in a House Bill substituted in by the Senate which is kinda unusual. So this bill is some clean up and further refinement of regulations in the penalties and remedies within facilities so we've worked This out with the department, with the facilities and with the patient advocates as far as I know everybody is on board with these fixes and changes and the modernization. The other piece that's on here is a bill that has run through his house several times removing the Sunset on the waiver for electronic supervision for Grandfather Mountain, a home for children and for Barium Springs so the bill, Representative Jordan, and Turner, and Dobson are on that bill. We've Hopefully finally we'll resolve this issue so unless somebody has some questions we can refer those to any detail questions to Representative Dobson/g but I appreciate your support. >> What purpose does the gentleman from Durham Representative Hall rise? >> I have a question, For the Bill sponsor or. >> Does the gentleman from Wake yield for the gentleman from Durham? >> I yield. >> He yields. >> Thank you Mr. Speaker and either for Representative [UNKNOWN] or whoever else might be working on this Bill and this a question of the electronic surveillance that's being done, it was previously, Sun setting and I just wanna clarify this, does this mean that going forward now this is state wide and those standards will be adopted and enforced state wide? >> No sir, what this does, this pilot has been underway for more than 10 years most of the time that I've been, Here in the legislature and Senator Hoil/g I think was the one who originated the Bill, it just involves those two facilities we had it at Grandfathered Mountain, it has really helped the safety and security of those young children at night and when Barium Springs, Which is also nationally known as well, when those two merged, what we did last year was extend this waiver to both facilities and
now we're just removing the sun set but all of the protections that we have had in there from the beginning for the department time [UNKNOWN]comes up will, Will still be there so all the protections in reviews will continue to be on going to make sure that it continues to operate and provide the safety for the children that it was intended to do originally. >> For what purpose does h e gentleman from [UNKNOWN] Representative, Rise? >>Point of inquiry. >> The gentleman may state his inquiry. >> Do we still have it in our rules about changing Bills, I mean totally changing them we send this Bill to the Senate, it was athletic trainer health coverage option and it comes back a totally different Bill. Those things happen. >> [LAUGH] >> Follow up. >> The gentleman is recognized for a follow up. >> I guess I just wanted to make the comment that it's happening more and more often and there's a whole bunch of them that are coming up that have been totally changed that we're gonna have to deal with so we need to look at them closely. >> The chair will point out that probably get worse before it get better. For that purpose does the lady from Mecklenberg representative [INAUDIBLE] rise. >> Inquiry of the chair. >> The lady is recognized for an inquiry. >> Isn't it true that if you sign down to a bill that left hand went with the senate and it comes back guided that we can remove our name? >> That is correct. > Thank you Thank you. >> Further discussion, further debate, if not the question for the house is the adoption of the motion that concur with the senate committee substitute to house bill 667, those in favor will vote aye, those oppose will vote no, the clerk will open the vote. [BLANK_AUDIO] [BLANK_AUDIO]. The clerk will lock the machine and record the vote. 110 having voted in the affirmative, none in the negative. the motion concur with the sent committee substitute the house bill 667 is adopted the bill is ordered and enrolled and sent to the governor. House bill 959, the clerk will read. >> Representative [INAUDIBLE] house bill 959 [INAUDIBLE] have to make various changes to the transportation laws of the state as recommended by the joint legislator of transportation oversight committee, general assembly of North Carolina next. >> The gentleman from [INAUDIBLE] representative [INAUDIBLE] is recognized for a motion for a motion. >> Thank you Mr. speaker I'll move not to conquer with house bill 959. >> Gentleman has moved that we not conquer, the gentleman is recognized to debate the motion. >> Thank you Mr. speaker, the bill went over and what we actually start is a simple agency there that went over to the senate with a few amendments which we made and those amendments have been moved around all day and we'd like to take that in conference and talk about some of those as well as there's a major issue that will be added to the bill hopefully and if you recognize representative [INAUDIBLE] he will speak to that major issue. >> For what purpose does the gentleman from Gastrin representative Representative [INAUDIBLE] arise. >> Speaking on the motion Mr. speaker. >> The gentleman is recognized to debate the motion. >> All the ladies and gentleman of the house this as Representative Baylor so properly put it is there's nothing really of concern of the current language within 959 I think was the number, everything has moved, we've met with our senator counterparts, we all agree on the language that is It's currently in, the reason we're not concurring is to add a piece of language that you all need to be made aware of. As you know, we have had some news about Map Act and how North Carolina in the last year went about capturing people's property for roads that was the Wrong way to do that. This body understood it was a wrong way to do that. So we have to address it for further out. So I wanna let you know that when the Bill comes back from conference a section will be added and Mr. Speaker if I need staff, I have them available if that would be appropriate, if there's any questions. When the Bill comes back, we'll have the Map Act, language in that Bill, here's some key points. You can go home and say that the current operational format and procedures under the Map Act are no more, they're gone. It provides one year for NCDOT to look at ad decide a path, Forward, okay, it also takes into consideration those impacted from a monetary situation, we do not have real numbers but we set a path forward as to what to do. We're also instructing DOT to address maps in three phases, ones that are complete, ones that are In process and ones that are future, so when we could bring the Bill back, we will go into more specific detail on those but I wanted to let everyone know that when it comes back it will have
a Map Act which is very substantial forward moving legislation on how we address public and private property when it comes to building roads. And we're available for any questions Mr. Speaker. >> Further discussion further debate, if not the question before the House is the adoption of the motion not to concur with the Senate committee substitute to house bill 959. Those in favor will vote I, those who oppose will vote no, the clerk will open the vote. The chair appoints the following conferees, Representative Iler chair, Representative Torbett shepherd, Tine, Burr and Kearney the Senate will be so notified For what purpose does the gentleman from Henderson, Representative McGrady rise? >> Inquiry to the chair. >> The gentleman may state his inquiry. >> We just voted not to concur with respect to House Bill 959 and you've now appointed a conference committee but the gentleman form Gaston indicated that the material that's being added to the bill Is gonna be completely new, would that not be subject to an objection if raised on the floor having not come through a committee and adding completely new material through a conference? >> The gentleman could make a motion that the conference report be referred to a committee at that point. >> Further inquiry to the chair. >> The gentleman is recognized for further inquiry >> Would it then not Be better procedure to send this to the appropriate subject matter committee tho work out this piece. >> The general rule, the conference committee is the one to work out the bill and to come up with a conference report, the bill will then at that point go to the subject matter committee. There's no procedure to because the only other way that that will be addressed would be if the chair would have name the entire committee as a conference committee and the chair doesn't believe that that's gonna be an efficient use of time, so let the chair thank the gentleman for his question. Senate Bill 805, the court will read.
