The House will come to order. Thank you Mr. Speaker, I appreciate that. Members in the house, all you have no doubt heard from your about the problems with consent to rape. His consent to rape means as you know if you constitution wants conses to the wake, then Sherry is stuck with that, with those increase as they may come over the years. That is not really an reform that helps your constituents. I appreciate what representative Miller has done in this Bill and particularly getting some language in the Bill that is better to help the consumer, but it's not enough because what the amendment does, is goes back to the original version of the Bill, the version of the bill as filed. if you wanted to have time to do that and find the original file version you could see on page 13, where its 30 to 23, the same lines the identical language as my amendment. In other words, this is the amendment in the eye of the insurance commissioner, as represents consumers. Consumers would under this amendment have to year by year consent to this increase in our insurance rates. this well was in the original bill, this strong language has been twiddle the way and members have I believe we need to go back to the original version, because that version,

empowered your constituents to be able to say no, to this rates as they went up year by year and allows them to say no, I would not automatically go along with this rates. Urge adoption of the amendment. for what purpose does the gentleman from Pender, Representative Millis rise? To speak on the amendment. The gentleman has the floor to debate the amendment. Ladies and gentlemen this amendment before you has been perfect for the original language has been purposely reformed in the reason so is that the actual reason for the bill this amendment wants to go back to, is actually all knowingly harmful to the consumer, what it actually does is require, year after year after year. A wet ink signature, that is unnecessary red tape as well as, it prefers uncertainty to the consumers that they actually have to go out, and possibly resign this in regards to future CTRs that could be actually experienced cancellation. The current language in the bill has all the protections to the consumer, to where the first considerate is actually signed by a wet signature. And if there is renewal, in that renewal, that there is proper disclosure that is in front of the policy holder, to what the Mc elaborate by the insurance commissioner. As well as what they have conceded to, as well as what the increases may be, so therefore, there is no need for the wet signature as representative Ludke is trying to go back  to, because the individual is consenting, once again by the way that they make the payment of the renewal, this is unnecessary regulation. There is not refer the consumer's protection action, the existing language in the bill has plenty of consumer protection, it is not weakening the aspects of the consumer but is basically eliminating unnecessary red tape, in unnecessary regulations. I would ask that you would defeat the amendment instead within the reform aspect it's a delay which is in the bill. For what purpose does the gentlemen from [xx] representative Tai rise. Debate the amendment the gentleman has the floor to debate the amendment Thank you Mr. Speaker and I rise to oppose this amendment as well and although I understand the intent, one of the issues is, this is the way we used to do it, back until I believed it was the mid 90s, and the problem was is the consumers were furious because you know, you don't always recognize as a renewal that you have to take action other than pay your premium, so people got very upset and frusttrated that their policy were cancelled Because they hadn't signed the form even though they'd sent their money in, so it actually was, although the intent is good the result really drove the consumers crazy so, I'd ask you to defeat the amendment. I have the great privilege of speaking on the confirmation of Dr. Linda Combs as our state controller today. House Joint Resolution 942 confirms the governor's appontment of Dr. Linda m.combs as our State Controller to serve a term beginning July 1, 2015 and expiring 30, 2022. The State Controller is responsible for maintaining the state accounting system administering the state dispersing system in accordance with our general statutes. While the state controller oversees many

vital and necessary tasks and ensure the proper functioning of state government, I'd like to take a minute to share what a distinguished and consummate professional dr.combs is. During her career dr.combs has worked for three US presidents and has earned five US senate confirmations. She has been the chief financial officer of the Environmental Protection Agency and the assisted secretary of the Department of Transportation. During her tenure in the private sector dr.combs found a three successful and took their products to worldwide distribution. Last but certainly not least, Dr. Combs served as controller of the United States of America from 2005 to 2007 where she reduced the audit completion time from five most to 45 days, reduced improper payments by $9 billion and disposed a four point five billion of our needed real property. I think we can all recognize this as an exceptionally distinguished career and I respectfully ask that you join with me today in voting to confirm Dr. Linda [xx] as our state controller. The gentleman has forwarded debate the bill Thank you Mr. Speaker, members of the house I just rise rather briefly to debate this resolution and not to repeat a wonderful job that the Rules Chairman did, but just to say in practice control occurrence has been in place now for several years and those of us in the preparations with the budget along with with others who have been working with her have found her to be just an outstanding public servant, she has brought a new, and fresh, and modern sense so that office and the state government operations and, I think many of us feel that her tenure as Controller of North Carolina, will leave us in a much better position in the state's financial position and it's financial influence in operations for many many years to come, and we are just very pleased and honor to have someone of her caliber agree to serve the great state of North Carolina For what purpose does the gentleman from Cameron, representative Glazier rise? She has had an extraordinary career, and maybe the best choice in the state this position as she was when we approved her tentatively sometimes ago. I have good the fortune with representative Don[sp?] to serve on a major retirement and system task force for half a year with dr.combs as a colleague and I found her to be extraordinarily collegial, and just an exceptional person. I think we are very very fortunate as a state that she is willing to continue in her role and I can't think of anyone in the state who will be better controller than dr.combs. For what purpose the gentleman from Cumberland Representative Floyd rise. To speak on the resolution Mr. Speaker. The gentleman has the floor to debate the resolution. Mr. Speaker I haven't heard dr.combs when she made her presentation to the general government, and hearing that presentation and looking at the way in which she presented it, it led me to believe that this was the right person for the right job. And in rules we provided additional information about her background and qualification which even will solve the point to me that she is the right person for the right job and this job. Today I stand before this party, in support for a 8 year term to expire in 2022, thank you Mr. Speaker. The next bill is senate bill 116, short title is handicapped parking windshield placard. The chair is reading it and it appears technical in some nature. Next bill is House Bill 533, the full title is an act to modify when to lean for deferred taxes on land eligible for present use value classification, is extinguished in order to promote sales for land, conservation, uses. Senate bill 123 the clerk will read Senator Hadson, Senate Bill 123, a bill to be entitled and act to  amend the Uniform Fraudulent Transfer Act to adopt the amendments approve by the uniform law commission in 2014 to make related conforming technical amendments, and recommended by the General Statutes Commission. General Assembly of North Carolina enacts. The gentleman from Guilford, Representative Blust is recognized to debate the bill. Thank you Mr. Speaker and members of the house. This is a bill that has been thoroughly vetted, it comes from the general statute commission and has the support of the business law, section of the board and bankruptcy law section of the bar, basically a fraudulent conveyance is, when a someone who owes money to keep creditors from being collected being able to collect what's owed by the person who owes them the money, transfers property out of his/her control or ownership to someone else so that the creditors don't have assets to get paid this Bill just makes some clarifying in technical changes, maybe the chief change here is to change the title from uniform fraudulent transfer act to the uniform voidable transfer act and that can be important because many times the personal entity which has the property transferred to it is not really involved in anything long they might just gotten what they thought was a good deal on something but they might have gotten, given not reasonably equivalent value and they take except when they get a letter from a creditor or a bankruptcy trustee or receiver for someone whose asking them for the value back and they say you've done certain fraudulent. It's both a law enforcement issue and a safety issue. but I guess it does need to

be said for the record that this house passed this Bill unanimously two years ago and it just languished until it's been brought back by Senator Cook and Representative Steinberg. It should have been passed two years ago. For what purpose from Mecklenburg Representative Gedo rise? See if representative Steinberg will yield for a question. Does the gentleman from chuan yield to the gentleman from Melconbug? Yes. He yields. Representative Stan burg I've gone through the bill and I see numerous places where it says trust the trailers have to have two lights. I can't find and admittedly, I didn't know the Bill was going to be on the floor until 10 months ago, where it says, a regular passenger vehicle must have two lights. In fact, the only section I can see says that, on a passenger vehicle, it just has to have a red light, it does not say it has to have more than one. I'm I missing that somewhere? and Lieutenant Griffin was the only black prisoner of war in [xx]. But the Russian  did us another favor. I grew up with a father who obviously suffered from PTSD even though we didn't have a name for back then, this safety depression is issues with alcohol will continuous through much altered but in 1985 the Soviet invited him to come back for a reunion at that camp because those Russian generals were aging up and they wanted to get back together, they would held a reunion, my dad did not want to go, but talking in the going, so he went back for their van and when he arrived, he run into two of the guys on the B-25 Bomber, that he was in when he was shot down of a arm that he rescued, he saved their lives, the thing that we my father suffered from was his mistreatment in that prison of war camp, but that's not what it was we didn't find the cell for many years later. My father was the last category of that aeroplane expect for the panel, the plane was shot up as it was going down, it was about a 1000 ft and they were flying country and my dad stood behind the pilot and said, aren't you going to get out of this airplane? He said, Jim, somebody is going to fly this airplane so my dad bailed out. He was immediately captured and for 40 years he believed that that power had flown that plane so he could live, that was the source of his PTST, but when he got back to the reunion, he ran to the other guys who were on the plane, and they spoke of the pilot in the present tense. And my father said, you mean he survived? And I said, yeah yeah he survived. It took down three years to find the pilot, and when he did find him the pilot said, yeah when you bailed out he said that took enough weight of the plane and I made it over that ridge we were flying towards and there was a 3000 ft valley near Arizona Italy and he said I flew as far as I could, let go the controls and I work my way out of the plain. He was later captured, but he was sent [xx] three. So, they had a good conversation and thanks to the rations that had that reunion my father PTSJ vaporized, and for last 20 years of his life, he was a different person. are able to be put together be ready for consideration for second reading on Wednesday and Thursday and probably no later than Thursday/ Friday. As you know, some of you know that are here, some of our more senior people who have put together the technical parts of the budget, people that you don't see have had a big turnover and so we all trying to be very cognizant. We are working with the central staff to make sure that we have the product when we need to have it available to the members for their consideration, but that's a general appropriations schedule for this week and for next week with the goal of being able to have our budget completed here in the house by the end of next week, and members under the number of folks will come to those, but just want to make sure members know tomorrow's plan because we heard the bills today, would appear that far as in session there would be no votes at this point at I don't want to work that down. There's a chance we may have to do a resolution concerning a joint session. And we don't know about that just yet, but that's the only thing the chair is aware of may be discussed and it's a joint session to honor Duke University on their National Championships so we're not sure if we're going to have to have a joint resolution or not. What the chair is going to do on this representative the chair is not going to instruct the subcommittee chair on how to run their committees if there were may be that the sub committee those has processes and little of no amendments it may be prepare to report the committee bill, committee report out by whatever time. I don't mind saying this here in session, what I would tell those committee chairs, if the committee chairs know of the amendments, our members it does if you're going to run the amendments to make the accommodations so the amendments can be run. That's generally a better use of time to do that in the sub-committee because if the amendments aren't heard there, one can rest assured they will probably be back in the full appropriations committee. So, I trust the committee chairs and subcommittee chairs will do that, will go under a schedule they deemed appropriate for that committee, but in such a matter that all the members of the committee will be able to run amendments amendment and have full consideration, and the workers say adding the bills to today's calendar, that tomorrow can be unimpeded so I believe that Representative [xx] is going to be [xx] time, but I don't want to prescribe a specific time because frankly some committees might not need it, and no one education can mean they going to use it all, they might be here at mid night I don't know but the other committees which may not take that much time.
